Terms of Service
Article 1 (Purpose)
These Terms of Service govern the rights, obligations, and responsibilities between Algionics Inc. (the Company) and any user (you) regarding your access to and use of the Company website, subscription plans, digital content, TradingView based delivery, and all related features and services (collectively, the Services).
Article 2 (Definitions)
Services means all functions and content provided by the Company through its website and related systems, including the following:
TradingView indicators, signals, alerts, invitations, access granting, and user guides
Subscription purchase, billing, renewal, and account status management
Notices, updates, and customer support
Any other digital content or functions the Company provides from time to time
User means any person who accesses or uses the Services.
Member means a user who completes account creation or any required verification and uses the Services.
Subscription means paid access rights granted for a defined period under the plan you purchase.
Content means all information and materials displayed or delivered through the Services, including indicators, signals, values, text, images, documents, code, and brand elements.
Third-party services means external platforms or systems not operated by the Company, including TradingView and payment processors.
Account sharing includes any of the following:
Multiple people using or accessing one account
Lending, selling, transferring, or sharing an account
Providing subscription benefits or access to any third party
Article 3 (Acceptance of Terms and Changes)
By accessing, browsing, registering, purchasing, or using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, you must stop using the Services.
The Company may modify these Terms to the extent permitted by applicable law.
If the Company changes these Terms, it will provide notice through the Services or another reasonable method.
If you do not agree to updated Terms, you may stop using the Services and cancel your Subscription.
Continued use of the Services after notice means you accept the updated Terms.
Article 4 (Important Notices and Disclaimers)
The Company is not a financial adviser, investment adviser, broker, dealer, or fiduciary, and does not provide financial advice.
The Services and Content are provided for informational and educational purposes only.
The Company does not guarantee profit, performance, results, or suitability for any particular strategy or user.
All trading decisions, order execution, risk management, and outcomes are solely your responsibility.
You are responsible for complying with the laws and regulations that apply to you based on your residence, location, citizenship, and use of third-party services.
Article 5 (Service Provision and Operations)
The Company may change the scope, features, structure, delivery method, or availability of the Services.
The Company may suspend all or part of the Services for maintenance, updates, security, or operational needs.
When reasonably possible, the Company will provide advance notice of planned interruptions. Emergency or security-related interruptions may be announced after the fact.
Article 6 (Dependence on TradingView and Other Third-Party Services)
Some or all parts of the Services depend on third-party services such as TradingView, including their policies, features, availability, and system status.
The following issues are not considered the Company fault and do not create Company liability:
Outages, maintenance, policy changes, feature changes, restrictions, or enforcement actions by TradingView or other third-party services
Limitations, suspensions, verification failures, or configuration issues on your TradingView account or other third-party accounts
Problems caused by your network, device, browser, operating system, regional restrictions, or user settings
Delays, failures, missing alerts, access issues, invitation delays, access granting delays, or feature restrictions that result from third-party services
The Company does not guarantee that third-party services will remain available, unchanged, or compatible with the Services.
Article 7 (Account Registration and Security)
You must provide accurate, current, and complete information when creating or using an account. You must keep your account information updated.
You are responsible for safeguarding your credentials and controlling access to your account.
You are responsible for all activities that occur under your account, unless prohibited by applicable law.
You must notify the Company promptly if you suspect unauthorized use or a security breach.
The Company may refuse registration, suspend, or terminate accounts in its reasonable discretion, including for suspected fraud, abuse, policy violations, or security risks.
Article 8 (Subscription, Billing, and Renewal)
Paid Services are offered by Subscription. Plan details, pricing, billing periods, and included features are shown on the purchase and plan pages.
Subscription fees are charged in advance.
Subscriptions may renew automatically unless you cancel.
If you cancel, you generally retain access until the end of the then-current billing period, and you will not be billed for the next period.
Payment processing, exchange rates, taxes, bank fees, and card issuer rules are determined by your payment method and the payment processor.
The Company may offer promotions, discounts, or coupons subject to eligibility rules and limitations disclosed at the time of offer.
Article 9 (Taxes and Additional Charges)
Depending on your location and the payment processor, taxes such as VAT or similar consumption taxes may apply.
Tax calculation, collection, invoicing, and receipts follow the payment processor policy and applicable law.
Article 10 (Cancellation, Refunds, and Exceptions)
Because the Services are digital content and digital services, refunds are generally limited.
Refunds are not provided for the following reasons: a. Change of mind b. Dissatisfaction with performance, trading results, or expected outcomes c. Lack of profitability or loss from trading d. Issues caused by your device, network, browser, settings, or regional restrictions e. Issues caused by TradingView or other third-party services
The Company may review and, at its discretion, approve a refund or payment reversal only in the following limited cases:
Clear billing errors such as duplicate charges
Payment completed but Subscription access was not granted due to a Company system error
A Company system outage that prevents the core service from being provided for 48 hours or longer, excluding any outage or limitation caused by TradingView or other third-party services
Refunds are not available when access failure results from user error, including incorrect TradingView ID input or missing required information.
If the Company approves a refund, processing time and method depend on the payment processor and your payment method.
Chargebacks and disputes follow the payment processor and card network rules and may override Company processes. The Company may suspend access during dispute review.
Article 11 (Service Restrictions and Termination)
The Company may restrict access, suspend features, or terminate your account if you violate these Terms or misuse the Services.
The Company may restrict access to protect security, comply with law, prevent abuse, or maintain system stability.
Upon termination or suspension, your right to access the Services may end immediately.
Data retention and deletion follow applicable law and the Company internal policies.
Article 12 (Prohibited Conduct)
You must not do any of the following
Account sharing, lending, resale, transfer, or any multi-user use of one account
Reselling subscription benefits, redistributing Content, reselling signals, or offering paid access based on the Services
Reverse engineering, copying, modifying, imitating, decompiling, or extracting any indicator logic, code, or proprietary Content
Attempting unauthorized access, exploiting vulnerabilities, scraping, excessive automated requests, or disrupting systems
Posting or distributing malware, spam, phishing, or illegal content
Infringing intellectual property or other rights of the Company or any third party
Defaming the Company or others, spreading false claims, or marketing the Services as guaranteed profit
Violating TradingView terms or any applicable laws and regulations
Article 13 (Intellectual Property and License)
All rights in the Services and Content belong to the Company or its licensors.
The Company grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services and Content for your personal use during an active Subscription, subject to these Terms.
You may not reproduce, distribute, publish, sell, license, create derivative works from, or commercially exploit any Content without prior written permission from the Company.
Any unauthorized use terminates the license automatically.
Article 14 (No Warranty)
The Services are provided as is and as available.
The Company disclaims all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Company does not warrant that the Services will be uninterrupted, secure, error-free, or free of delays, including delays caused by third-party services.
Market data, indicator outputs, and displayed results may vary due to external factors, data feeds, and platform constraints.
Article 15 (Limitation of Liability)
To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, trading losses, loss of data, loss of goodwill, or loss of use.
The Company is not liable for any loss resulting from your trading decisions or your reliance on Content.
The Company is not liable for failures or limitations caused by TradingView or other third-party services.
If liability is found despite these Terms, the Company total aggregate liability is limited to the amount you paid to the Company for the Subscription during the period reasonably related to the claim, to the extent permitted by law.
Article 16 (Privacy)
The Privacy Policy explains how the Company collects, uses, and shares information. By using the Services, you agree to the Privacy Policy.
Article 17 (Indemnification)
You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising from:
Your violation of these Terms
Your misuse of the Services
Your violation of laws or third-party rights
Your account sharing, resale, redistribution, or other prohibited conduct
Article 18 (Governing Law and Jurisdiction)
These Terms are governed by the laws of the Republic of Korea.
Any dispute arising out of or relating to the Services or these Terms will be subject to the exclusive jurisdiction of the Busan District Court.
